Construction law

Constructing solid legal foundations for your projects

In the development of a project, it is very common for problems to emerge among the various intervening agents (architect, quantity surveyor, developer, construction company or even the final customer). When this moment arrives, the greatest problem lies in determining who is liable and to what extent they must respond.

What are the most common liabilities when it comes to construction?

The law says that the agents involved in the construction are liable to the owners and to the acquirers of the buildings for the material damages caused in the building, within the indicated deadlines, depending on the severity of said damage. Specifically, the most common damages that arise following the construction of a building are usually:

  • Falta de impermeabilización y aparición de humedades.
  • The appearance of cracks or fissures.
  • Improper thermal or acoustic insulation.
  • Damage to the structure of the building (for example in beams, load-bearing walls or other structural elements).
  • Defects in the finishing of the building.

How do we approach these matters? We need to be aware of the fact that even though problems frequently arise following the construction of a building, each specific case and its peculiarities must be studied individually. At ALCÁZAR, we make sure to analyse each specific situation, collaborating with experts specialising in construction pathologies in order to obtain an expert report where the actual liabilities are established.
