DESCRIPTION: The Registry of Judicial Unpaid Debts will allow lawyers to collect debts on behalf of their clients with greater speed and agility, reducing costs and collection time in a completely transparent and secure manner. This registry even allows the registration of the debt in a file of defaulters enabled in the Platform of the Registry of Judicial Defaults managed by the Spanish Bar Association, so that customers will receive a more complete and effective legal advice.
The Consejo General de la Abogacía Española, through Infraestructura Tecnológica CGAE, S.L. and in collaboration with Inversiones Colectivas en Red, S.L. has set up an online platform specialized in debt collection, called Registro de Impagos Judiciales.
The Registry of Judicial Unpaid Debts allows lawyers to manage the collection of debts on behalf of their clients, regardless of whether the debt has been claimed extrajudicially or judicially, even if there is a final resolution that recognizes the amount owed.
The collection management of outstanding debts is carried out by means of requests made by the internal and external agents that provide services for the Registry of Judicial Unpaid Debts, thus reducing the costs of the claim. In the event that this is unsuccessful, the debtor will be included in the file of defaulters in the Registry of Judicial Defaults, directly affecting the risk assessment processes used by financial institutions to analyze the debtor’s risk levels, financial capacity and business reputation.
In this way, clients who require legal advice will be able to know the status of their debts in a more agile way and will also be able to benefit from the advantages of the information system of outstanding debts of legal entities and individuals, thus allowing them to know the possible risks or the suitability of existing or future legal relationships.
The platform will be accessed with the lawyer identification provided by the Bar Associations to their respective lawyers, so that any member of the Bar Association will be able to access and, therefore, benefit from the advantages offered by the Registry of Judicial Unpaid Debts for the collection of overdue debts. The platform, to make the requirement prior to the inclusion of debtors in the file of defaulters of the Registry of Judicial Defaults, facilitates doing so both by postal bureaufax and by registered letter.
Finally, in the event that the debtor does not pay the debt within five days, the debtor will be included in the file of defaulters enabled on the platform to publicize the existence of the outstanding debt.
Therefore, the Registry of Judicial Unpaid Debts will include the debts due and payable that exceed the amount of fifty Euros claimed and not paid by the debtors. However, the Registry of Judicial Defaults is not indefinite; rather, there is a limited period of time to remain in the Registry.
Therefore, through the new platform created by the Consejo General de la Abogacía Española:
- the claim for overdue and unpaid debts, both pre-judicial and judicial, can be made by means of a summons;
- also makes it possible to publish unpaid debts and the holder of the debt in the file of the Registry of Judicial Unpaid Debts, creating a public list of defaulters that will make it possible to publicize the debts claimed;
- Finally, and in relation to the above, registration in the Register will make it possible to consult overdue and unpaid debts, both of legal entities and individuals, so that the level of risk of a contracting by the debtor can be assessed.
In addition to the agility and speed provided by the new Registry for the collection of overdue debts, having been created by the General Council of Spanish Lawyers, it guarantees the thorough respect of the current legislation, the Code of Ethics of Spanish Lawyers and the requirements set by the Spanish Data Protection Agency, without this affecting the objectives of the Registry of Judicial Unpaid Debts.
Consequently, the Registry of Judicial Unpaid Debts will raise the quality standards and success rate of the professional services provided by lawyers, facilitating the collection of the amounts owed and improving the advice on contracting risks.
